These Terms of Service ("Terms") govern your access to and use of Agent One's websites, applications, hosted AI agents, chat widgets, APIs, and related services (collectively, the "Service"). These Terms are a legally binding agreement between you and Agent One ("Agent One," "we," "us," and "our").
By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.
Some tools and agents are operated by Agent One itself for our own product, marketing, support, research, or internal use ("Agent One-operated tools"). Other agents are created, configured, deployed, or controlled by customers for their own websites, products, businesses, or users ("customer-controlled agents"). These Terms distinguish between those categories where relevant.
Agent One lets users create, configure, host, embed, and manage AI agents for websites, applications, customer support, lead capture, workflows, and related use cases. The Service may include agent builders, chat widgets, hosted pages, custom domains, knowledge uploads, integrations, analytics, conversation history, templates, and APIs.
We may change, improve, suspend, or discontinue features from time to time. We are not required to maintain every feature or integration indefinitely.
You must provide accurate account information and keep your login credentials secure. You are responsible for all activity under your account, workspace, agents, API keys, and integrations.
You may not use the Service if you are under 13 years old or if applicable law prohibits you from using the Service.
"Customer Content" means content you or your users submit to the Service, including prompts, instructions, agent configurations, uploaded files, website content, API configuration, conversation messages, lead submissions, feedback, and related materials.
As between you and Agent One, you retain your rights in Customer Content. You grant Agent One a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display, analyze, and otherwise use Customer Content as needed to provide, secure, support, and improve the Service, including to run AI agents, generate responses, maintain conversation history, provide analytics, debug issues, prevent abuse, and comply with law.
You represent that you have all rights and permissions needed to submit Customer Content to the Service and to allow Agent One to use it as described in these Terms and our Privacy Policy.
Agent One may process conversation data and related Customer Content to provide AI responses, maintain conversation history, show analytics, improve the relevant agent, troubleshoot issues, monitor safety, prevent abuse, and improve Agent One's features, quality, reliability, and performance.
Agent One may use aggregated, de-identified, or otherwise minimized information derived from Customer Content and use of the Service for internal analytics, product research, evaluation, benchmarking, and feature improvement.
For customer-controlled agents, Agent One will not sell raw conversation logs, uploaded customer files, customer prompts, customer end-user messages, or lead capture submissions as a standalone dataset. Agent One will not license customer-controlled agent conversations as a commercial training dataset or use them to train general-purpose third-party AI models unless we have appropriate permission, an explicit opt-in, or another valid legal basis.
For Agent One-operated tools, Agent One may use de-identified, aggregated, or otherwise minimized conversation data and usage patterns to build internal research, benchmarks, evaluation sets, product insights, and quality-improvement datasets for Agent One and related first-party tools. If Agent One offers any commercial dataset, model training dataset, or external licensing program based on Agent One-operated tool data, Agent One will use additional safeguards and provide notice, consent, opt-out, or other controls where required by law or by the context in which the data was collected.
AI-generated outputs may be inaccurate, incomplete, offensive, or unsuitable for your use case. You are responsible for reviewing, testing, and validating your agents, prompts, knowledge sources, integrations, and outputs before relying on them.
The Service is not a substitute for professional legal, medical, financial, security, or other expert advice. You are responsible for how you use AI outputs and for any decisions made based on them.
If you deploy an Agent One agent on your website, domain, product, or customer channel, you are responsible for your relationship with your end users. This includes providing required notices, obtaining required consents, honoring privacy rights, and complying with laws that apply to your business and users.
You may not use the Service to collect or process sensitive, regulated, or confidential information unless you have the right to do so and your use of the Service is appropriate for that data. This includes health information, financial account data, government identifiers, children's data, passwords, API keys, private credentials, and trade secrets.
The Service may use or connect with third-party services, including AI model providers, payment processors, hosting providers, analytics tools, communication tools, APIs, and customer-configured integrations. Your use of third-party services may be subject to their own terms and policies.
You are responsible for integrations, API endpoints, credentials, webhooks, and third-party tools you configure or authorize.
You may not use the Service to:
Paid plans renew on the billing cycle shown at checkout unless canceled. You authorize us and our payment providers to charge applicable fees, taxes, and renewal payments. You may cancel your subscription at any time through the Service or by contacting us.
Unless required by law or expressly stated otherwise, payments are non-refundable. We may provide refunds at our discretion.
Agent One and its software, designs, branding, interfaces, features, documentation, and other materials are owned by Agent One or its licensors. Except for the limited right to use the Service under these Terms, we do not grant you any rights in Agent One's intellectual property.
If you provide feedback, suggestions, or ideas, you grant Agent One the right to use them without restriction or compensation.
We may suspend or terminate access to the Service if we believe you violated these Terms, created risk for Agent One or others, failed to pay fees, or used the Service in a way that may harm security, availability, compliance, or trust.
You may stop using the Service at any time. Some provisions of these Terms will survive termination, including provisions about Customer Content licenses already needed to operate the Service, payment obligations, disclaimers, limits of liability, and dispute-related terms.
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Service will be uninterrupted, error-free, secure, or accurate, or that AI outputs will meet your requirements.
To the maximum extent permitted by law, Agent One will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or reputational harm. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid to Agent One for the Service in the three months before the event giving rise to the claim.
You will defend, indemnify, and hold harmless Agent One from claims, damages, liabilities, losses, and expenses arising from your Customer Content, your agents, your integrations, your end-user relationships, your violation of these Terms, or your violation of law or third-party rights.
We may update these Terms from time to time. We will post the updated version on this page and update the "last updated" date. If changes are material, we will provide notice where required. Continued use of the Service after updated Terms become effective means you accept the updated Terms.
